一、條款接受

您下載、註冊或使用 Eduvance AI（「本應用程式」）即視為您已閱讀、理解並同意受本使用條款與條件（「本條款」）約束。若您不同意本條款，請立即停止使用本應用程式。

若您未滿您所在司法管轄區的成年年齡（例如18歲），或您是13歲以下的兒童，您必須讓您的父母或法定監護人代表您審閱並同意本條款。您使用本應用程式即表示您聲明已獲得該等必要的同意。

二、應用程式用途與服務

Eduvance AI 提供以人工智能（AI）生成的學習見解、應試準備材料及練習，專門協助學生應考香港中學文憑考試（HKDSE）中文科。本應用程式旨在供個人非商業教育用途。

本應用程式可能提供免費及付費訂閱服務（「專業版」）。免費服務可能包含功能限制（例如每週使用次數限制）及可能展示廣告。專業版訂閱將提供額外功能及／或無限制使用權限，具體詳情將於訂閱時列明。

三、帳戶安全

您須負責維護您帳戶登入資訊（包括密碼）的機密性，並對透過您帳戶進行的所有活動負責。若懷疑帳戶遭未經授權存取，請立即通知我們。因您的疏忽導致帳戶遭未經授權存取，本公司恕不負責。

四、用戶內容

當您使用本應用程式的特定功能（例如作文評改），您可能會提交您的原創內容，如文字（「用戶內容」）。您保留您用戶內容的所有權。然而，透過提交用戶內容，您授予 Eduvance AI 一項全球性、非專屬、免版稅、可再授權且可轉讓的許可，以使用、複製、修改、處理、改編、分發及展示該用戶內容，其唯一目的是向您提供及改進本應用程式的功能（例如提供AI評分及回饋）。

您聲明並保證您擁有提交用戶內容所需的一切權利，且您的用戶內容不侵犯任何第三方權利，亦不包含任何非法、誹謗或有害材料。

五、智慧財產權

本應用程式內所有內容，包括但不限於文字、圖像、設計、軟件、AI 生成之內容及建議（不包括您的用戶內容），均為 Eduvance AI 或其授權方之財產，並受版權及其他智慧財產權法保護。

未經本公司書面授權，您不得複製、修改、散播、銷售、出租或商業利用本應用程式的任何部分或其內容。您可以出於個人教育目的使用 AI 生成的內容，但需理解其僅供參考。

六、訂閱條款

若您選擇訂閱專業版服務，您的訂閱將根據購買時列明的條款自動續期（例如按月或按年），除非在當前訂閱期結束前至少24小時取消。付款將透過您選擇的支付方式（例如Apple App Store或Google Play Store）處理。您可以隨時透過您的應用程式商店帳戶設定管理或取消您的訂閱。所有費用均不設退款，除非適用法律另有規定。我們保留隨時更改訂閱費用及服務的權利，任何更改將在通知您後於下一個續訂週期生效。

七、禁止行為

您同意不進行以下任何行為：

• 違反任何適用法律或法規；
• 提交任何侵權、誹謗、淫褻、攻擊性或有害的內容；
• 試圖未經授權存取本應用程式的系統或用戶帳戶；
• 對本應用程式的任何部分進行逆向工程、反編譯或反彙編；
• 使用本應用程式進行任何商業活動，除非得到明確授權；
• 干擾或試圖干擾本應用程式的正常運作或安全性。

八、免責聲明及責任限制

Eduvance AI 致力提供高質素的學習內容及 AI 生成的見解。然而，本應用程式及其所有內容均按「現狀」及「可用」的基礎提供，不附帶任何明示或暗示的保證。我們不保證 AI 生成內容的準確性、完整性、可靠性或適用性。AI 生成的建議及評估僅供參考，不應被視為專業意見。

我們不保證您能透過使用本應用程式提高考試或學業成績，亦不對您因使用本應用程式所產生的任何學術或考試結果負責。在法律允許的最大範圍內，Eduvance AI 不對因使用或無法使用本應用程式而導致的任何直接、間接、附帶、特殊或後果性損害承擔責任。

九、第三方服務

本應用程式可能整合或連結至第三方服務。您對這些第三方服務的使用可能受其各自條款與條件及隱私政策的約束。我們不對任何第三方服務的內容、功能或行為負責。

十、條款修訂

Eduvance AI 保留隨時酌情修改本條款的權利。任何修改將於本應用程式內或我們的官方網站上公佈。我們建議您定期查閱本條款。在修改公佈後繼續使用本應用程式即表示您接受該等修改。

十一、終止

若您違反本條款，我們可隨時暫停或終止您存取本應用程式的權限，恕不另行通知。您亦可隨時停止使用本應用程式並刪除您的帳戶。

十二、適用法律

本使用條款受香港特別行政區法律所管轄，並按其解釋。

1. Acceptance of Terms

By downloading, registering for, or using Eduvance AI (“the App”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with these Terms, please cease use of the App immediately.

If you are under the age of majority in your jurisdiction (e.g., 18 years old), or if you are a child under the age of 13, you must have your parent or legal guardian review and agree to these Terms on your behalf. Your use of the App signifies that such necessary consent has been obtained.

2. Use of App and Services

Eduvance AI provides AI-generated insights, exam preparation materials, and exercises specifically tailored for the HKDSE Chinese examination. The App is intended for personal, non-commercial educational use only.

The App may offer both free and paid subscription services ("Pro Version"). Free services may have functional limitations (e.g., weekly usage quotas) and may display advertisements. Pro Version subscriptions will provide access to additional features and/or unlimited usage, as detailed at the time of subscription.

3. Account Responsibility

You are responsible for maintaining the confidentiality of your account login information (including your password) and for all activities that occur under your account. Notify us immediately of any suspected unauthorized access. Eduvance AI is not responsible for unauthorized access resulting from your negligence.

4. User Content

When you use certain features of the App (e.g., essay grading), you may submit your original content, such as text ("User Content"). You retain ownership of your User Content. However, by submitting User Content, you grant Eduvance AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, process, adapt, distribute, and display such User Content solely for the purpose of providing and improving the App's features to you (e.g., providing AI scores and feedback).

You represent and warrant that you have all necessary rights to submit User Content and that your User Content does not infringe any third-party rights or contain any unlawful, defamatory, or harmful material.

5. Intellectual Property

All content provided by Eduvance AI, including but not limited to text, graphics, designs, software, AI-generated content and suggestions (excluding your User Content), is the property of Eduvance AI or its licensors and is protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, or commercially exploit any part of the App or its content without our express written consent. You may use AI-generated content for personal educational purposes, understanding that it is for guidance only.

6. Subscription Terms

If you choose to subscribe to a Pro Version, your subscription will automatically renew (e.g., monthly or annually) according to the terms presented at the time of purchase, unless cancelled at least 24 hours before the end of the current subscription period. Payments will be processed through your chosen payment method (e.g., Apple App Store or Google Play Store). You can manage or cancel your subscription at any time through your app store account settings. All fees are non-refundable unless otherwise required by applicable law. We reserve the right to change subscription fees and services at any time, with any changes taking effect in the next renewal cycle after notice to you.

7. Prohibited Conduct

You agree not to engage in any of the following activities:

• Violating any applicable laws or regulations;
• Submitting any infringing, defamatory, obscene, offensive, or harmful content;
• Attempting to gain unauthorized access to the App's systems or user accounts;
• Reverse engineering, decompiling, or disassembling any part of the App;
• Using the App for any commercial purposes unless expressly authorized;
• Interfering with or attempting to disrupt the proper functioning or security of the App.

8. Disclaimers and Limitation of Liability

Eduvance AI strives to provide high-quality learning content and AI-generated insights. However, the App and all its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant the accuracy, completeness, reliability, or suitability of AI-generated content. AI-generated advice and assessments are for informational purposes only and should not be considered professional advice.

We do not guarantee exam success or improved academic performance through the use of the App. We are not responsible for any academic or exam results obtained from using the App. To the fullest extent permitted by law, Eduvance AI shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the App.

9. Third-Party Services

The App may integrate with or link to third-party services. Your use of these third-party services may be subject to their respective terms and conditions and privacy policies. We are not responsible for the content, functionality, or practices of any third-party services.

10. Modifications to Terms

Eduvance AI reserves the right to modify these Terms at any time in its sole discretion. Any modifications will be posted within the App or on our official website. We encourage you to review these Terms periodically. Your continued use of the App after modifications are posted constitutes your acceptance of such modifications.

11. Termination

We may suspend or terminate your access to the App at any time, without prior notice, if you breach these Terms. You may also stop using the App and delete your account at any time.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
